A trust contest is similar to a will dispute in that they are both caused by various interactions and interrelationships of grantors, caretakers, trustees, and beneficiaries. Often the disagreement will involve a trustee or beneficiary making a claim that another individual engaged in coercion or undue influence of the trustor (grantor). In the state of California, the Civil Code allows for a trust contest or will contest related to the estate of the decedent. Persons may raise an objection as to the validity of a document based on the grantor’s incapacity, or fraud in the inducement, or if the trustor was under duress.
